PLEASE ADVISE AS LANDLORD FOR UPSTAIR PROPETY HAS NOT RETURNED MY CALLS AND THE TENANTS HE HAS IN HIS PROPERTY SAY THEY SEE NO WATER LEAKAGE. ALL I CAN THINK TO DO IS CALL OUT A PLUMBER, BUT ITS NOT MY PROPERTY AT FAULT (I DONT THINK.) IN DESPERATE NEED OF HELP

Call your local council. It is actually the landlords problem, the landlord should deal with it.

You could call a housing charity - like shelter or citizens advice, housing aid, or try your local council who should also help even though it is a weekend.
Failing that, get in a plumber but keep all receipts and make sure you take legal advice as your landlord should reimburse you.
Are your landlord and the upstairs landlord the same? Do you own your flat? You really need to get advice on this one!

It's up to the tenants and the appropriate landlord to sort out this problem, you should get in touch with your landlord as this situation is damaging to his property, he may be able to force the landlord into repairing the leak other than that you could try the local council housing department or environmental health, just say you think it is a toilet leak & upstairs wont fix it and they will be round in a shot

It depends whether the water pipe is a mains water pipe or some other pipe such as a washing machine. If it is the latter then the landlord for the upstairs property is responsible. Not sure about the first, it may be your local council

Whoever is responsible - it sure isn't YOU!!

If the landlord refuses to accept that there is a problem; there are a whole host of official bodies to help you get justice.

One thing I want to offer you - remember that YOU are in the right - and the landlord is in the WRONG!

So don't worry about being 'nice' - after all, he hasn't!!

Nobody will judge you for being strong in this situation; though they would probably call you a wimp if you WEREN'T!!!!!

I wish you good luck; though you don't NEED it - the LAW is on your side.

If you can sort it out by talking to the tenants and getting them to understand what the issue is then they might be able to help by talking to the landlord and getting him to make the repairs.

Always try and deal with these matters with as little official interference as possible, this approach drags things out and often it blows things out of proportion. But if you have been as tactful as possible and still haven't got anywhere then go to the housing department - it would normally have a name like private sector housing or something similar. Council departments vary quite a lot in their effectiveness and expertise so if they are too slow then go seek legal advise.

Have had similar problem previously - although it is the other flats problem - you will have to claim through your household insurance and they will chase the landlord for compensation for the redecoration of your flat - if no insurance you will have to call a plumber pay the initial cost and if water is coming from the other flat - claim for plumber and full cost of redecoration through small claims court.

its the landlord for upstairs property, he should be maintaining his property. if it is a block of apartments and it is a structural problem, then the property developer is to blame. if, for just peace of mind, you call a plumber, make sure to get a receipt and as soon as its established who is at fault, pass it over and you will be reimbursed.

i had the exact same problem a few years ago with the girl above me. Water was dripping for weeks from above and eventually a big water blister formed which burst and caused a big hole in our roof!!!! she denied all knowledge as well ,but it turned out to be a small pipe under the floor boards connecting the toilet and the overflow pipe was broken.my father - in law is an old school plumber and spotted it right away . they need to get a plumber out not you !!! and et them to check under the floor boards for a similar problem . make sure you get their insurance details make a claim asap !!!!!! GOOD LUCK !!!!!!

Contact your Insurance Company, they will sort out the landlord, repair your property and deal with any mis-givings.
