Sea Gull's are protected, rats are not. They are considered a pestilence by the government, whereas seagulls are. Before killing an animal, just check your local ordinances for what is legal and what isn't. Call your local police department they would be glad to let you know what's legal and what's not. Police are there to educate too.

There is a big difference between a sea gull and a rat. A rat is a rodent, and is considerd a pest. It is open season on them. They are not on any protected, or endangered species list.

cruelty to an animal consists of torturous behavior, so if you are killing a rat for the purpose of pest control im sure that is no problem there but if you were to capture the rodent alive and tie it alive by its tail and were to use it for target practice with your BB gun or set it afire, that could be construed as torturous cruelty...get it now
