You can try pleading your case to the department head, but don't expect too much - especially if a syllabus was handed out with the deadline on it, or if the deadline was repeatedly mentioned in class, and you weren't there to hear it.
The only way I could see this as working out in your favor is if you'd received high marks on all your other assignments and tests in the class - it shows credibility. If you have, and the department head still won't listen, take your case to the Dean of Student Affairs. Make sure you have as much documentation as you can - such as returned homework assignments, and a copy of the syllabus (which should NOT have the hand-in date on it!)
I hate to break it to you, but whatever your situation, you probably can't sue your instructor, unless NOBODY in the class knew when to hand in the assignment, which I doubt. Granted, your instructor did mislead you, and that sucks, however - you're in college now. Your instructors expect you to attend class. They're not there to hold your hand - you have to take responsibility for knowing when things are due and making sure you have them in on time.

Sueing, while it may sound satisfying, is not going to help. Go to the DEAN, maybe find out if some OTHER students are getting screwed out of their grades too and bring them along. I had to do that once, and I hinted at legal action.

It is your responsibility to make sure that you know the deadline for reports. Apologize to her, let her know you won't make that mistake again, and ask her if there is any way you can get credit for the work that you did.

Sueing is a logn process and it is costly so you probably wont go anywhere. Compaired to a paid lecturer, you are small and wont get anywhere.

Anyone can sue but it doesn't mean you can win. Tell her that you should not be punished for her error. Talk to her superior about it.
