My friend married in the Philippines and then moved to Japan, can she legally be divorced in Philippines and Japan? Also, is it true that she wouldn't be allowed back into Philippines because she became divorced? Any reading material (websites) on that would also be helpful.

i DON'T think she would not be allowed back in the philippines if she were divorced. what are they gonna do if she was divorced? it has nothing to do with the immigration system. also there are illegal americans in there... it doesn't bother anybody there. i think they can actually even work there. some of them movie stars.

the question is, did your friend marry in church or in city hall? because in my opinion, if she was married in the city hall and wanted a divorce, i think she can file for it in japan (not sure about this... depends on their law) but she would need an honest lawyer to take care of it and the spouse would have to sign it also. if she was married in church, that's tough. you have to file for annulment and it's going to be submitted to the Vatican in Rome, and that takes a very long time.

i've heard of cases of people married in church (whether be it in the philippines or other country) and file for divorce (not annulment) in las vegas, nevada. it was granted, but it was just divorce. meaning they cannot get married in church again, unless annulment has been filed and granted by the vatican.

bottomline is, each country have their own laws. like the case i mentioned above about divorce in nevada, technically you are divorced in the united states, but if you were to come to the country where you got married, you are still considered married. you are only single in the country where you filed for divorce. for formality's sake, i think it is easier to apply for legal separation in the country where you got married. also this doesn't work otherwise... meaning if you got married in the philippines, and were to come to another country... that doesn't mean you're single. you're still married wherever you go, unless you file for divorce -- but you will only be single in the place where you filed for it.

In the Philippines, there is no divorce. It is illegal. I know this for a fact. So that being said, she can divorce in another country but will still be considered married in the Philippines. She can go back to the Philippines but cannot get remarried there. I know many people from the Philippines that got divorced under foreign law and got remarried in another country.

My sister was separated from her husband almost two years ago. They lived together for more than a year in Laos but were married in the Philippines. An annulment of marriage is allegedly due in December this year.

Annulment requires more Legalization process, while divorce just requires short time..

She will need to seek an annulment, not a divorce.

If she has just cause for being apart from her husband, it will likely be granted.
