You need to apply on three, possibly four different levels to end up with a 501(c)(3) tax-exempt nonprofit corporation:

1. The Secretary of State in your state, to first form the nonprofit corporation;

2. The IRS, to get your federal tax determination letter for federal tax exemption (see www.irs.gov);

3. Your State taxing authority, to get state tax exemption; and

4. Possibly your State attorney general's office, which usually monitors nonprofits to be sure they are being managed in the public interest.

The whole approval process involving all three or four entities typically takes 6-9 months. Good luck.

What did your attorney tell you? You'd better not have done this without an attorney!
