I have a sandwich shop here in spain and i would like to open a chain. First i must patent the name.. How and where?

You don't patent a name, you patent an invention. Your sandwich shop's name is not an invention in that sense. So you're looking for Trademark.

First off, if you created the name you already own the trademark. You have the right to stick the little TM logo next to the name. That is a threat to possible competitors; it says "I know my rights".

But it's not enough. Secondly, you register the trademark (some people here have already given you the address for that in EU). A trademark can be a logo or any number of things, but it can also be a word or phrase provided it is distinctive enough. That is formally called a "word mark".

If your shop is called "Sandwich Shop" and you have no logo, forget both.

If your shop is called "SSrrnDDDWcccHH SHEEEooooOOOPPP!!!" and has a distinctive logo, then you could register both.

Only once a logo or wordmark is registered can you use the little R with a circle round it.

It takes aaaages.

I got my lawyer to do it, simple as that. No legal fee, everything is FOC because that lawyer is my sister.
