ABSOLUTELY! You can sue for yourself and your daughter for loss of work time and personal injury. She's having pain from "something". It takes a few days to experience any neck/whiplash pain. If you feel it's worth it, get a good lawyer. He will, of course, take 30% of your settlement. If you do it yourself, the insurance company will try to settle with as little as possible. You don't need to sue unless the other insurance company doesn't pay the bills. What usually happens is they'll pay your bills, and offer you a small amount for pain and suffering without you having to hire an attorney. When they give you an offer you can turn it down or counteroffer with a higher number.
BUT... it sounds like this accident recently happened because your auto will be fixed today. So don't go settling anything until your daughter feels 100% for awhile.

It depends.....if the truck's insurance company is going to pay your daughters medical bills and prescription for pain meds, and pay for your car to be fixed. Then I say no....if they don't then yes, but only for the amount that you owe in bills due to the accident. That's my advice.
