the truck admitts fault and they do have insurance,my car will be fix today,my daughter went to eme. room she was treated and release with pain med. do i sue their insurance co. for my daughter?

ABSOLUTELY! You can sue for yourself and your daughter for loss of work time and personal injury. She's having pain from "something". It takes a few days to experience any neck/whiplash pain. If you feel it's worth it, get a good lawyer. He will, of course, take 30% of your settlement. If you do it yourself, the insurance company will try to settle with as little as possible. You can do a consult with most attorneys for free; and he can tell you if your case is worth $$ or not. Good luck.

You don't need to sue unless the other insurance company doesn't pay the bills. What usually happens is they'll pay your bills, and offer you a small amount for pain and suffering without you having to hire an attorney. When they give you an offer you can turn it down or counteroffer with a higher number.

BUT... it sounds like this accident recently happened because your auto will be fixed today. So don't go settling anything until your daughter feels 100% for awhile.

It depends.....if the truck's insurance company is going to pay your daughters medical bills and prescription for pain meds, and pay for your car to be fixed. Then I say no....if they don't then yes, but only for the amount that you owe in bills due to the accident. That's my advice.

If your daughter was treated and released, and your car is being fixed, why would you want to sue? That's just crazy!

IF YOU HAVE NO INJURIES YOU HAVE NO LAW SUIT. A LAWYER WONT HELP BECAUSE THERE IS NO MONEY IN IT.
RIGHT NOW YOU HAVE TO WAIT FOR RESIDUAL LONG TERM EFFECTS. THAT IS, SEE A DOCTOR WHO CAN TELL YOU IF THERE WILL BE ANY DAMAGE DOWN THE ROAD YEARS YEARS FROM NOW.

ONLYTHE LAW PROFFESSION TOUTS THE LEGAL SYSTEM.

I would at least talk to a lawyer and see if you have a case....most lawyers will have a free "initial consultation"
