im talking about during the wait before you go to court i here it takes up to 3 months or longer to get to court. what happens do you still have to live in the same house or can one have to leave. Sometimes he gets mean and drinks alot and he wants me and the kids to get out.These are not are kids together,and both are names are on the home.

It depends on if want of you wants to keep the home or not...if one of you wants to keep the home you have to buy the other person put...if not you sell it and split the money 50/50

I don't recommend using separate lawyers but I instead think you should consider going to mediation: it is ironic but during this time you should make a greater effort to get along than whe you were married because it can save much grief and money. We used mediation and was able to legally separated and file the divorce papers in less than 3 months! But that was because we were friendly toward each other.

Mediation should be more amicable and significantly less costly. When I divorced we refinanced the mortgage and transferred the deed to the party who remained in the house. So one person cashed out on 1/2 of the equity and gave up interest in the property. It is quick and easy and doesn't result in the sale of the house. The mortgage company will provide an appraisal so that you have an objective valuation of the house.

Typically, the house will be split 50/50 unless one party buys the other out to retain the home.

If he is drinking and becomes abusive, call the cops and have them file a TRO (temporary restraining order) which will buy you time to get a permanent restraining order. You and the kids should never have to tolerate that. If he will not leave, you can insist the police make him leave. If he is abusive, they will handle it. I've been there.

It usually breaks up the home and the family and in divorce everything is pretty much 50/50

Get a lawyer.... totally depends on state to state on how the home and money is divide.
