Yes. First you have to have a reason. That will determine where you have to file your lawsuit. If you may file in Canada, hire a Canadian attorney, have the defendant served per Canadian law and go to court.

If your lawsuit must be filed in the US, it gets a little trickier. The Canadian may be served in accordance with US law if he/she is served while in the US; if, however, the Canadian stays in Canada, she/he must be served under the provisions of The Hague Convention on Service of Process, or in accordance with a treaty between the US and Canada. The Hague Convention is somewhat complicated, and generally requires that international service be transmitted through diplomatic channels. I believe there is a bilateral treaty which allows process from US courts to be served in Canada in the same manner Canadian Court documents are served. Again, this is complicated and you will need an attorney who has done it before.

No, of course not. Haven't you heard? Canada has no legal system--has no need for a legal system--it's just a few people holding hands and skipping around in fur coats up there.

You can but the most pressing problem would be: "Where to file and how does a court get jurisdiction over the person?" You need to consult a lawyer.

Well if the problem occured in the US, as in they were supposed to send you something & never did (fraud), sure you can just file suit in your local court just like they lived in another state.
