call your local superior court and speak with thier Small Claims Advisor. in a small claims case lawyers are not admissible in court and you will be on a level playing field with your defendant. however there are limitations as to the ammount you can claim in small claims ct. so, pick up the small claims papers at your court, fill them out and have your SC advisor help you with anything you may not understand. if you happen to live in Ca heres a good link to start off with for some general info. good luck!

I spent 3 years in law school and I've been a practicing lawyer since 1993. If I talked to you for about and hour, you might have some BASIC idea of how to start the process. You can save yourself a lot of hassle by just going to see an attorney for further assistance.

You can just "file" a judgment. You have to file a lawsuit and prove your case in court. If you manage to win, the court might draw up the judgment for you or you might need to submit a form for the judge to sign. The procedure will vary form court to court.

Exactly what the previous person said! You have to go through the court process to receive a judgment---depending on difficulty, get a lawyer.
