If a customer comes into my store and is a total jack***, er... jerk, do I as the store owner have the right to tell the customer to leave and not return because I will not accept them as a customer anymore?

Your question relates to the "shopkeeper's rights," and one of those rights is to ask a patron to leave the premises. This request is ususally followed up by a "no-trespass" order from the police that officially advises the individual that they are not wanted on the premises. I assume that you know that you may not exclude someone based on any of the factor articulated in Title VII of the United States Code -- specifically: race, color, religion, national origin, gender, disability.

You bet you do. Especially if you feel that the customer is upsetting any other customers. You can "Tresspass" them and call the police on it. Do not put up with customers who make the world a far worse place than it has to be. The customer is NOT always right.

If your business is privately owned and operated, and is NOT in ANY way related to the government or benefits from government assistance, then you are free to serve or refuse to serve anyone you want.

However, the minute your business become affiliated with the government (for example, you store is attached to and benefits from a government-owned parking deck), you cannot refuse service to just anyone. This is because doing so reflects upon the government, as well.

There is a gas station near me who for years has had a big sign out front that says "No Cumberland Farms costumers allowed"! There is a Cumberland Farms store right across the street from them and nobody has done anything about it! So I guess you can ban a customer!

Yes you do..all you need to do is post a sign on the door that says." We reserve the right to refuse service to customers"

I've seen signs in some stores and restaurants that say they have the right to refuse service to anyone.

Can you get the jerk on the "No shoes, no shirt, no service" sign.

If he's drunk you can turn him out.

Yes, you can refuse to serve them. Being a jerk is interfering with the conduct of your business.

Certainly, if you have a good reason. However, if you do not have a good reason, it could easily turn into a discrimination case.
