Well, the second and third are part of the instructions, and thus part of your answer.

As far as "tortious liability" you're basically asking for an overview of where and how tort law evolved. Or your being asked about a specific tort based on the fact pattern that you haven't included in your question.

Since, someone else doing your homework for you doesn't help you, this is for everyone else.

Think of all law is divided along two lines, forming a 2x2 box.

Along the top (horizontally), you have "Did something Bad" and "Did something that you Agreed not to do".
Along the side, you have "Punished by State" and below that "Punished by (or Liable to) Person Harmed".

The top left corner would be: Did something Bad, Punished by State. Those are crimes, an fall within the criminal law arena.

The bottom left corner would be: Did something Bad, Punished by (or Liable to) Person Harmed. Those would be torts, one half of civil law.

The bottom right corner would be: Did something that you Agreed not to do, Liable to Person Harmed. That is contract law, the other half of civil law.

The top right corner would be: Did something that you Agreed not to do, Punished by State. This category doesn't really exist, but the closest match is administrative hearings for licensure violations.
