I think it would depend on where they are in the world.
In England it is illegal to have sex under the age of 16. So if she WAS 16 when she fell pregnant I don't think it is rape.
Hoever it may be the case in America because I think the legal age for sex there is 18.

under those circumstances, it is HIGHLY unlikely that a court would be in favor of charges of statuatory rape. The age difference is so small there would have to be a strong argument saying the female's metal capacity is less than someone 17yrs of age

By law it is, if the girl or her parents choose to press charges. That's why it's called "statutory rape" - it's violating the statutes (laws) regarding an adult having sex with a minor.

If a underage girl (under 18) has sex with a underage guy it's not illegal.
But if a underage boy (under 18) has sex with an underage girl then it is illegal.

no. If the girl did it willingly then it is NOT rape.
However, the guy will have to pay child support.

unless he harm her that would concidered as rape....but i think even it's not it'sstill a rape cause the girl is not yet in her legal age...
