What should be done/what are the consequences if someone did this to me...?
In the bathroom wall at school it was found that someone had written a direct death threat threatening to kill two people with a gun at a specific time. Deans have been notified, but what can be done now (this is for a friend) because the evidence strongly points to a specific kid? And what would happen to someone who was convicted of this? Much thanks!

A threat of violence (in this case, a death threat) is legally considered an assault. It is a form of stalking. Law enforcement is only beginning to understand how to deal with this relatively new crime.

It is good that you notified the Dean but you should also notify campus Public Safety and the local police. A picture should be taken of the wall and the time and date noted. A police report should be made including pertinent details of your relationship to the person who committed the assault.

Unless you have a personal protection order (restraining order), the police can only make a report. Sometimes the police will not even make a report UNLESS you have a personal protection order. Usually to obtain a restraining order, you must go to the courthouse not the police. A local domestic violence shelter will probably have the information available about obtaining a personal protection order in your locality. Many domestic violence shelters will give you legal help to file a personal protection order.

If you DON'T get a protection order, ... the police will not be able to help you (or your next of kin) until AFTER you get injured!

Have a safety plan. Stalking is a serious, potentially life-threatening crime. Even in its less severe forms, it permanently changes the lives of the people who are victimized by this crime, as well as affecting their friends, families, and co-workers. Sadly, some stalkers are not deterred by restraining orders and may do life threatening harm so assess your situation CAREFULLY.

You might want to attend one of these meetings to learn more about how stalking is handled in the judicial system in your area. These parents have suffered a great loss and can discuss the seriousness of the issue that faces you. It is usually these parents and people from domestic violence shelters who work with legislators in their state to pass legislation that deals with stalkers and abusers, so the parents who have suffered a loss may be willing to take time and tell you about the current laws and punshment for assault and battery in your community and about pending legislation.

Dont just stop at the deans, make sure the authorities have been notified and the child that is being threatened needs to bring this to his/her parents attention, it doesnt matter what happens to the person convicted of this, this is an awful thing and it needs to be taken personally and handled before someone gets hurt, please make sure you as well as the friend get help from parents, deans, authorities, social services, etc.

It will become a legal matter and the courts will have to decide what to do. I hope this person gets a mental evaluation. It sounds like he is a very sick and confused person. I'm glad he wrote the threat so that he could be stopped before he carried it out. That means he wanted to be caught and that should be taken into consideration.

Contact the authorities; police, school counselors, etc. It's better to be safe than sorry, it's a cliche' but it's the truth. Situations like this have to be taken very seriously, look at some of the school violence that has happened in the last couple of years.

Someone doesn't even know it, but you probably saved live(s), i don't know law at all, but don't blame yourself for the turn-out. You did what you were compelled to do. Plain and simple! Do your best to move on in the way you should, remember you are not to blame, you were put in that situation!! Too bad you have to go through something like this at such a young age. Good Luck and I pray in a short time this will be over for you.

get an emergency restraining order asap!!! He would have murder charges. It was plotted and then acted apon.
