She scheduled 3 hearings and cancelled all 3 for various reasons. Will the petition die of after a certian amount of time? I am in Georgia.

Why, so you can stay married to someone that wants a divorce? Strange, strange, strange world we live in. You should file and set the hearings and if she doesn't show up, you get everything.

Depends on the state and what stage the case is in. It may also depend on the reasons the three hearings were cancelled. The only way to find out is to consult a lawyer in the county where the case is pending and ask.

But, even if the petition is dismissed, she can always file another one.

If you want the marriage to end, file an answer and set your own hearing.

I know nothing of Georgia law, but in other states, if she fails to perform the conditions of a petition, it WILL die.

Courts don't like to be jerked around. I think in many states the limit is 6 months.

Sounds like to me that she doesn't want a divorce if she keeps postponing the hearing. Of course, if you are not contesting it & signed a waiver of non-appearance then you shouldn't have to go. Have you talked to your lawyer about this issue, that would be the best step to take. It is probally not much difference but in Arkansas, you have 30days.

Most courts have a time limit and then it just dies. If she is canceling more than likely the court will get sick of it and tell her she will have to refile.

I don't know if it is because she doesn't want it or if it is financial, but I agree with a few of the others - file it yourself. You don't want to hold on to someone that doesn't want to be with you.

doesnt sound like she wants t he divorce after all or she cant afford it .. so if you still want to go thru with the divorce file yourself.
