For full custody, you would have to prove to a judge that the other parent was a danger to the child, such as with alcohol, drug, or physical abuse. Sometimes emotional abuse flies but not always. Even in these cases there can be supervised visitation rights. A friend of mine's ex-boyfriend went to prison. After he got out, the court allowed him supervised visitation, even after some problems with the police concerning his twins.

Joint custody can be as little as every other weekend with the other parent.

The legal battle to change custody may create more damage than good. Having your daughter choose to come live with you with the support of your former spouse would be the best scenario. This is possible for anyone who is on good terms with their ex. So get on good terms!

If u are married to her father then you won't have full custody. It isn't even an issue. You have joint custody until you were to split up and it was established through the courts in which case you would have to prove him unfit to have no custody at all. Why would this be a concern if you are married anyhow. You may want to get counseling.

Think about what you want.A child has the right to have the love of both parents. If he is a good father don´t let your circunstances with your husband interfer in the best of your daughter. But i would need more information on your really situation to give you a good answer.

Are you saying you don't want your husband to have custody of your daughter, or is this a daughter from a previous relationship?

I would first talk to your lawyer. But i can tell you this with out a reason they will not take a child away from either parent..you have to prove that the other parent is unsuitable to raise the child. If you cant it will defiantly be joint custody.
