why is pot illegal in the USA but yet pot merchandise that promotes is on the market?

Every state I lived in they were always busting stores that sold paraphernalia. Maybe it's changed now, but it sure used to be breaking the law. I haven't heard for a few years now.

Different states have different laws on what they view as paraphenalia. Mere wrappers are not because they can be used to roll tobacco. Some pipes are not seen as illegal for the same reason. The more exotic or specialized the items, the more likely it will be considered as paraphenalia.

The best theory I have heard so far is that hemp fibers are used in the production of our paper currency. The paper our money is printed on is unique in the world, which makes it difficult to counterfeit. If everyone were growing hemp, there would be an uncontrollable supply of the material used to make our money.

its important to note that HEMP generally speeking is banned in US not just the hemp that produces THC (the drug that gets you high). hemp threatened certain long standing industries and new materials industries as well. the long standing industries, Cotton and Lumber. more hemp could be produced in 1 acre of land than 3 acres of cotton or lumber and it grew faster. Many senators in those days had there lives built on those industries. not to mention Dupont had just produced a new synthetic super fiber (dont remember which one, i think nylon) dupont help to fund the anti hemp movement because a natural fiber was still many times stronger than they were producing. 2 senators dupont and the us treasury came up with a scare tactic, calling it Marijuana, it was to use words people didnt understand to scare them into thinking Hemp was bad. the true definition of Marijuana means "Fiberus Plant"

edited-- forgot to add this: its considered paraphenalia when the drug is present, else its a novelty item or "used to smoke tobacco" in some states, if that item is in open view it is cause for having you or your car/home searched for Marijuana. if Marijuana is found than your charged with possetion of drug paraphenalia

because they are considered 'novelty' items. like small pipes, hookas,and bongs. the rolling papers are also used for tobacco.
t shirt, and stuff with the images and things are covered under 'freedom of speech'

I dont know that is the first time I have thought about it and I think you are right, it shouldnt be legal.

that is way beyond me. however, i think freedom of speech has something to do with it...we can talk about it, but we can't do it...lol...
