I went to a game on 5/26/06 while visiting a friend who lives in the bronx and noticed there were people buying and selling peanuts all around me!!!! How dare they? i am severely allergic to peanuts! The next day I broke out in hives and my tongue swelled out of my head.

look, how am i supposed to know that i should take responsibility for my own akshuns if there are no warnings telling me peanuts are around? I know people eat them at the ball park but i assumed BECUZ THIS IS THE US OF A, that there are designated Peanuts-Only section! isn't our country more advanced than that? this is all yankee stadium's fault!

I answered your other question, the one where you want to sue to change the lyrics of "take me out to the ball game"....but the stupidity you display is so great that I just couldn't resist posting an answer here also.

You sir, are an idiot. Assuming that all of this isn't just a lie, which I am not totally convinced that it isn't, you would have no basis for a suit. Here's why (I alluded to this in the other post). All ballparks, restaurants, or any place serving food products that contain or otherwise have contact with nuts or nut products are required by law to post signage stating so. Every ballpark in America that sells concessions does, including Yankee Stadium. So this means one of 2 possible things: a) you ignored the signs, b) you didn't see the signs (it's not their fault you can't read). In either case, they are guiltless, and you're an idiot. Any suit you file would be laughed out of court.

Laying all that aside, and again assuming that this isn't all just a lie, let's look at something else you are sorely lacking... COMMON SENSE. Baseball has been played since the 1860's, and since that time, peanuts have been served and sold as snacks at virtually every organized professional baseball game played for the last 130+ years. What made you think they wouldn't serve them at Yankee Stadium? Were they supposed to just intuitively know that you were coming and stop all sales just for you? Please.

Bottom Line, either you are a) lying, or b) stupid, or c) both. My guess is C. Grow up, get a life, and stop wasting air.

There are allergies of all types all over the place. When one goes to a public function, one has to look out for themselves. Did the stadium sell the peanuts or did someone bring them in. Most of the time food is listed at the concession stand. If you are that severly allergic, you may want to consider calling locations first, before attending. Not sure you will win a case if you decide to go forward.

Please don't be one of those people who tie up the courts with bogus claims. If you have peanut allergy's you would also be aware that most foods come into contact with some form of nuts. People have been selling peanuts at baseball games sense the birth of the stadiums. Why not sue because they sell hot dogs. You never know whats in those. Give me a break.

My daughter is allergic to peanuts - so I understand your concern and how sensitive people can be to having peanuts around them.

However, any person in their right mind knows that peanuts are sold at Yankee stadium (and most ballparks) so I am sorry you had the reaction, but there is no way you have any basis for legal action.

I think you can sue them only because that happened in the US. In most other countries, that would never be taken seriously. To sue someone originally means that you are convinced someone has committed a crime. And if someone commits a crime, he/she is dangerous to the society.
In many countries, to sue someone is a very very very serious thing, the most extreme you can do. Before that, you should always try to adjust first. If suing was that easy, the world would be filled with signs: warning: don't enter this stadium if you're allergic on milk, if you can't stand girls with blond hair, if you want to be sure no-one is going to spill coffee on your T-shirt accidentally...
So the answer is: I think you can, in the US. In the US only.

As far as I know you have to come in contact with(at the very least) or eat something with the nuts you are allergic to inside. I have never heard of a reaction from just being in the same place!! I think you are either sue happy or stupid to think we would actually think this was a serious question. I am in the medical field

what planet are you from. peanuts... hot dogs...and cold beer ..that is the american way for baseball and most other sports events. i dont think you have a chance in ..... but who knows... every one knows coffee is hot... but some one is richer..for spilling it on herself. it is my opinion that cases like this are the reason for high prices.. in health insurance..and medical care. these law suits are why most people hesitate to assist another who have been injured. this is why good doctors are leaving hospitals and their professions in droves. sad..thing.. frivolous lawsuits. now if you were served something at a place.. that claimed no peanuts were in it... that would be different..story. but i cannot believe you or anyone else is unaware of what food is served at a ball stadium.

I'm sure you can sue them, but frankly, if the judge does not dismiss your case as frivolous I shall have lost all faith in the American legal system. If you have such severe peanut allergies, you should not go to places where the sale of peanuts is one of the essential attractions. Sorry, but this is one of those cases where you really should have known better.

are you kidding me. it's a baseball game of course there were going to be peanuts. the two just go together. that's like me going to a rock concert and complaining about smelling marijuana it's going to happen, someones going to light that dubbie and pass it down the line just like someones going to crack that shell at a baseball game. I am not trying to be hateful but come on you should have known
