I'm not speaking about after school or team type chorus but standard run during the day "music" curriculum chorus.

i graduated 1979 and back then we did have to try out.

A lot of school programs require a "try-out". Schools are struggling with budget cut backs and there is only so much room in the more popular classes. I honestly wouldn't want to take a class a that is based on talent if I had none....I mean, I KNOW I have a voice like a frog and I wouldn't want to have to sing in front of people with it.

it doesn't matter if its a "mundane" music curriculum course.

people still have to try out for tennis and soccer and basketball and almost any other sports, and most states require some sort of physical education credit.

choir isn't required, and there are a lot of other musical options in most school (band orchestra) that will take anyone (you'll be put in the worst group).

why would it be illegal?

Why on earth would it not be legal? If you're going to be part of any team you'll have to "try out" (an audition effectively). Your fellow team (chorus) members aren't going to be happy if you join and can't sing, letting them down and wasting all their hard work!

From a music teacher's point of view, choral groups at the higher level often compete for statewide honors, and so they sometimes are choosy for students who can match pitch well at the higher choirs.

It is legal.

I am against NOT including students who want to sing in ANY choirs.

i would say yes. Just like any other club or team that can pick and choose its members
