We are California residents. We dont own any property, no kids. Debt is approx. $6K. Marriage has lasted 5years, 2months. Can I use the "Summary Action" form for divorce?

no, to be able to fill out a Summary Dissolution, you have to have been married less than 5 yrs. you just missed it. sorry
also, if your debt was acquired after your marraige, it must be less than 4K. most Ca courts have family law facilitators who can help you fill out your paperwork free of charge. call your local courthouse for info.

Yes. You have a simple situation and it would be silly to pay for lawyers and such. You can file and serve him. He will have 30 days to respond after benig served, and if he does not you can get a summary judgement.

Take care of how you say "no property." Cars and furniture all count! Anything that is not clearly "personal" (think clothing, gifts, books) counts, though you should be able to split up the little stuff without the courts getting involved anyway.

Debt has nothing to do with a divorce. You can file.

I don't know about California but here in BC I did it and my debt is way above $4k

dont matter how much your debt is you still can file even if your 25000 dollars in debt that dont have anything to do with it
