I live in Washington State, and the school district here is trying to pass a policy at the Middle School (5th-8th) and the High School (9th-12th) grades. There is a meeting on it tonight and I would like to no whether it is legal or not?The notice said "anyone they suspect" either on drugs or drinking they can take into the office and drug test with a mouth swab.

Drug testing in school is legal although many people say that the testing violates the student's rights of privacy. But these arguments have lately been excluded for athletes because they may, obviously, be taking performance-enhancing drugs like anabolic steroids. These tests can also be done for other drugs such as marijuana, cocaine, and heroine. Schools may also expel students from athletics for repeatedly smoking on school property as is the rules at my own school. They catch you smokin' 3 times and you're gone. We almost didn't have a wrestling team because of this. Drinking can also be checked for by urine samples but that isn't exactly done as much as other tests. The last 2 sources listed prove that the Supreme Court did indeed allow random drug testing for student athletes but it does not say anything about your average student you pass by in the hallway. But I believe there is an "unwriten policy" that says that if school teachers and/or officials see 3 signs of drug use in a student they have the legal rights to test that student for drugs. Definitely bring up that at your meeting since it should be standard proceedures across the board at all high schools in the nation. And the first link just has news stories about drug testing, sorry if there's any adds in there for testing/pass-your-drug-test products because those came with the search for that stuff.

In school you really have no rights. The bill of rights just barely applies to public schools. But yeah they're legal for some stupid reason.

Tho I don't understand how they plan to keep kids in school and kick them out for trying drugs at the same time. A very large percentage of kids can fail a drug test on any given day. Whether for doing drugs, having prescriptions, or eating poppy seed muffins.

They already do that where I live. The parents have to sign a waver at the beginning of the school year to give the school permission, though. That is if I'm remembering correctly. I haven't been in highschool for a while.

I don't know if it is legal or not, but I think it should be. Drugs and alcohol do not belong in schools. I would vote for that. Even if it was someone they "suspect", better be safe than sorry.

Yes, but the parents have to want their kids get tested. Other wise you can't test a kid for drugs.

I would have to say legal because you are on their property and they can search you after all you can choose if you want to be in their school or not.

No, it probably isn't, but you would have to mount a legal challenge to prevent them from doing it anyway.
