I was rolling a blunt by the emergency stairs when regular security guy "not a cop" took the weed off my hands than call the police, i was with 2 more friends.

If this is your first time possession offence, when you go to court (if there is one), just talk to District Attorney before the hearing. Ask him about a plea bargain. Basically, if you show remorse, the judge will give you a mouthful warning and will (most likely) let you go. You have to stay off of the weed for the time being, until things are clear with the situation. It doesn't sound like a big deal. What YOU DON'T want is to get caught DEALING the stuff. Then you should probably see an attorney. But for now, just show everyone that you feel bad, and it should be all right. Good luck.

Unfortunately you really can't do anything. Security isn't the same as police but they still have the right to seize illegal drugs. You might have been ok had you not allowed him to take the weed. Now he has evidence and is going to be looked at as from the Judge as doing the right thing, whereas you will be looked at as some punk kid who got caught rolling a blunt. Sorry dude, good luck though.

Before answering this question I have two. Did your friends get the heat with you? And if you had the blunt lit? First of all you have to look at the fact on whether or not where you were standing was considered private property. If so the way you can fight this is to find out what's your state law regarding "private property". You also need to find out if your friends are willing to testify with or against you.
Also, if the blunt was lit you can get a lesser case(if it goes that far) with just having in controlled substance. Which consequently, is less time. If the blunt wasn't lit they could easily charge you with intent to sell/deliver. Again, all depending on where you live and who the arresting officer is (you know how they could be).

just not a smart thing to do in public. You should've taken care of businees in the privacy of your own home. Did the guard really call the cops or keep your stash for himself? If police were involved, you may be charged a misdomenear (a crime that is less serious than a felony and is usually punishable by fine, penalty, forfeiture, or confinement in a place other than prison), depending on the amount you were in possession of.

Security guards have at least the powers of the citizen, which includes the power to do what is commonly known as "citizen's arrest" and to hold a subject until the police arrive. Looks to me like that is what he did. The owner of the property may have given him more authority beyond that, obviously he had the authority to order you out of the property. If he caught you, and the police subsequently arrested you, and you really want to 'fight' it, please consult an attorney.

First of all if you roll a blunt in public your asking to get caught. A "rent-a-cop" does have authority to seize your marijuana and hold you until the police arrive.

i wouldn't think there would be enough there for them to make a huge deal out of it. Probably will get a citation and a ticket. Piece of advice though.......maybe roll the blunt IN your condo and go somewhere else to smoke it.

It's only a ticket anything under an ounce is a ticket! Unless your under 18 then I dont know! And this is in California! I don't do it I use to! It just makes me lazy and unproductive! It hurts your sex life if you use it too much! I recommend not using it! Then you wont have issues whatsoever! SO dont worry its only 1 blunt a ticket!

Well it all depends I would of denied it and said the security guard threatened me and that weed was planted on me. Have your two friends back you up.
If no cameras were there, its you and your friends words VS. his, but then again this would be the evil thing to do.
