I wanted the security depost back when I turned in the key and she agreed and wrote me out a check which later bounced. I called her and she said she would send me another check. by law she has 45 days to return the security deposit. If she does not send it should I call her and give her 10 days to send or just file a small claim in the county courthouse and summons her to a hearing to retrieve the funds? We are not really friends we were just roomates as I answered her ad for a roomate from the newspaper.

She's already shown that she cannot be trusted if she gave you a bad ck. If you call her at all, It should be to let her know that you will not accept another personal ck for return of deposit. Request that she give you a certified ck or money order.

After the 45 day, just take her to court, let them deal with her as she has already shown a lack of respect to you by neglecting her obligations as your landlord.

take her to court
even if you win you get a judgement
even if she cannot pay she have a judgement against her
then file a lien against her ( even if she has no perosnal property, she have a tough time removing the lien until it's is satisfied ).
