Got into a car accident a month ago hired a lawyer the next day. Im still sitting here with no car, lost my job, unbelieveable pain, and no signs of anything soon. Should i fire my lawyer and get a new one, or should i wait another month and see what happens? How do i got about firing my lawyer and getting a new one?

Have you followed up with your lawyer? That might be faster than firing one and getting another. You could email him some message like 'I know you are really busy, and perhaps I should get my file back.' However, I'd try just following up first. Otherwise, ask what he/she thinks you owe them first, or you might find out he/she has incurred time behind the scenes that you will pay for and have nothing to show for.

Also, if you signed a contract, there might be something in there you need to take into account.

Your attorney should know physicians that work on the agreement that they will be paid for their bills. You might have to sign a piece of paper saying this effect but its better than sitting around in pain. I would call my attorney and explain whats going on with you physically and see what he can advise you. As far as your car you should have already settled on that (most insurance companies want to get that part out of the way quickly). Just be honest with your lawyer and ask him exactly whats going on with your case and what the delay is in getting your car replaced. If you don't get a satisfying answer then please by all means feel free to get a free consultation from another attorney. I will say this that as a rule the longer the deliberation goes between attorneys, insurance companies and the plantiff it can go either way. Sometimes (not all) you can do better by not using an attorney although I am sure your attorney would disagree with this opinion.

Your are free to fire you lawyer and hire a new one any time, but your current lawyer might be entitled to a lien for the services he/she has already provided.

Before doing anything, you should talk to your lawyer about your concerns. Ask him/her to explain the process to you. Lawyers cannot snap their fingers and magically force the other side to settle. The opposing insurance carrier may dispute liability or the necessity for some of your medical treatment. it may be too early to ascertain how much you should expect in a settlement.

Sometimes it is helpful to wait to file a lawsuit until you have reached your maximum recovery. The value of the case depends on many factors. How long will you be off work? Will you need future medical treatment? Are you injuries permanent?

There may be many reasons why the case seems to be moving slowly, so talk to your attorney first.

Without understanding what state or nation the incident happened in, it's elaborate to reply. In the US, it'll rely on whether or not you reside in a "no-fault" state or now not. Even then, the detail of rage or motive to harm any one, whoever it was once, could deliver you a declare you could now not or else have. Your age and state of wellbeing are going to complicate issues, in order that, if there's little coverage and the opposite driving force does now not have a lot in the way in which of cash or different resources, one of the crucial huge individual harm regulation businesses is not going to wish to take in your case. But obviously get your self the high-quality PI (individual harm) attorney you'll uncover.

you call your lawyer, and say..."you're fired" or, that you are going with another attorney....if he asks why, let him know you are unhappy....he works for you. Then get out the yellow pages, and call around. Make appointments with a few...they should have free consultations.....then decide who is best for you.
