Statutory Rape. Not sure of the law, I'm sure it's wrong if not legally, morally. If he feels he really love her, he'd wait till she's at least 18! My Son is 19, I don't feel that an 18 year old has much to offer a 45 year old man other than sex. They're not on the same level. What will they talk about? Acne, The Prom, Bow Wow or some other young group? Tell this 16 year old that she has plenty of guys her age or slightly older if that's what she prefers. She might be looking for a Father figure. Statutory Rape, and the adults that agree with it are accessories to the crime. If this is a friend of yours tell your friend to ask the man if he had a 16 year old daughter and a 45 year old man was having an affair with her what honestly would he do? He probably would try to kill him or put him in jail. Try to take her around some 16 & 17 year old boys that are nice and see if you can convince her to date guys her age and not guys that could be her father because that is incest (also a crime).

Obviously both parties involved have some serious self esteem issues. What could people of those ages have in common? Now two-hundred years ago this wouldn't be too unheard of; but I think this is one of the areas our culture has definitely wised up. Twenty nine years difference is just wrong no matter what ages are involved; maybe I'd go for 70 and 100 year olds but that's about it.
Second of all (as if there needs to be more argument) whoever this man is he's gutless. Affairs are cheating and that is in my opinion one of the worst things one human being can do to another, supposedly loved one. If you're not that happy with your marriage, then man-up and say so, why people live with such big lies is beyond me; but I can take comfort in knowing that what goes around comes around and this person is going to find themselves alone and miserable.

This is not intended to be legal advice. Based on my interpretation of N.J.S.A. 2C:14-2, it is legal for a 45 year old man to "ha[ve] an affair" (making an assumption as to what "an affair" means in this context) with a 16 year old girl unless:

1. The affair is accompanied with coercion or force.
2. The affair is with someone who exercises supervisory or disciplinary control over the victim.
3. The actor is related to the victim by less than the third degree.

Honey it's considered child abuse. A 45 year old man has no business having an affair with a 16 year old, even if that girl is mature beyond years...it's inappropriate and against the law. In Georgia the age of consent is 16, but for a man to stoop that low has got to reevaluate his morals legal or not.
In Colorado the new law allows young girls at 15 to get get married. So the world is changing, but personally myself, women over 30 are much better mates and come with lots of experience:) My daughter is 17 and if she dates a man at 45, I'd have to make sure she is in College first before making drastic decisions.

But if I'm the 45 year old guy I get the girl a convincing fake ID that says she's 18 and get a copy of it. IF the issue ever comes up in court, I point to this as evidence in my defense that I took every reasonable percaussion to ascertain the proper age and then just have a good time!!!

it is pretty pathetic but judgment aside ( I don't think you are looking for opinions here), here is a page that states the laws for new jersey. I can't find where it talks about 16 and over, like here in Florida, if the gurl is at least 16 the guy can be up to 24 before it is illegal, if she is under 16 and the guy is 16 it is still illegal in Fla. of course I only perused this page , I didn't read it. read it and find your answer. after reading the page , i can't find any where in the state of new jersey that the old coot has committed a crime. someone else read it and see if you can find a place , it appears the age of consent in jersey is 16.

I think that it is molesting a child >>>> I do not care whom agrees with it . The 45 year old man is an adult and should know that it is wrong even to think of this ... If it was my daughter and you had an affair with her you would be in jail for rape .
