幾位大大都說得很好(尤其是Abermin跟Kievew), 在下學了不少. 感謝分享! ^_^
"專利"在中文的原始含意應該是"經由一定程序而得到認可及保障的權利", 一般就是翻為[patent].
但是在"沉默是我的專利"中, 應該指的是"引申意", 表示["專屬的/特有的"權利].
Kievew所用的[prerogative]的確是"特權", 不過在英英字典的解釋中可以看到, 它特別是指"經由繼承"/"經由法律認可"的特權.
如果泛指"獨享/與大多數人不同"的特權(可以是由個人或法律許可), 我會用[privilege(名詞)]/[privileged(形容詞)].
所以,
"沉默是我的專利"
I am privileged to [be/remain] silent.

口語上的確用大家常用跟熟悉的慣用句比較恰當, 不過既然是"翻譯", 總是希望能夠儘量符合"信, 雅, 達"的要求.

法律用語，005的夠標準。
最常用的是：I have the right to remain silent.
要不然輕鬆一點就說：I opt to remain silent. 或 Silent is gold－沉默是金
口語上儘量用大家常用跟熟悉的慣用句，要不然聽起來太過文皺皺，很不自然。寫的話才儘量正式完，因為讀的人有大把時間去翻字典。

"Privilege" refers to a given right: "it is a privilege to vote".
"Keep silent" here is more like a chosen right.
I used "prerogative" because it is often used in conversation to be "I/they have the right to..." with or without the legal implication.
