第五章 退 休

第四十七條:自請退休
本公司勞工有下列情形之一者,得自請退休:
1.工作十五年以上年滿五十五歲者。
2.工作二十五年以上者。
第四十八條:強制退休
勞工有下列情形之一者,本公司得強制其退休:
1.年滿六十歲者。
2.心神喪失或身體殘廢不堪勝任工作者。
前項第一款所規定之年齡,對於擔任具有危險、堅強體力等特殊性質之工作者,本公司得報請中央主管機關核准調整。但不得少於五十五歲。
第四十九條:退休金之給與標準
本公司勞工退休金之給與標準如下
按其工作年資,每滿一年給與兩個基數。但超過十五年之工作年資,每滿一年給與一個基數,最高總數以四十五個基數為限。未滿半年者以半年計;滿半年者以一年計。最高總數以四十五個基數為限。
第五十條:退休金給付
本公司應給付勞工之退休金,自勞工退休之日起三十日內給付之。惟當公司依法提撥之退休準備金不敷支付或事業之經營、財務確有困難時,得報主管機關核定分期給付。
第五十一條:服務年資併計
勞工之工作年資以服務本公司者為限。惟受本公司調動之工作年資和現在本公司雇主接替時即予留任之勞工,其年資由本公司續予承認,並應予合併計算。
第六章童工與女工

第五十二條:童工僱用
本公司因業務需要得僱用十五歲以上未滿十六歲之童工從事工作,惟不得從事繁重及危險性工作。
第五十三條:童工保護
本公司童工受僱時須提出其法定代理人之同意書及其年齡證明文件;每日工作時間不得超過八小時,例假日不得工作,而且不得於午後八時至翌晨六時之時間內工作。
第五十四條:工作時間的保護
3.上下班時間以每星期一至星期五,上午九點/九點半至下午六點/六點半,請務必打卡。
4.午休時間由中午十二點至下午一點,共一小時。
當日工作未完成,請利用其他時間完成。
第五十五條:產假
本公司女工分娩前後應停止工作,給予產假八星期;妊娠三個月以上流產者,應停止工作,給予產假四星期。
第五十六條:分娩前後的保護
女工在妊娠期間,本公司若有較為輕易之工作,得申請改調,工資不予減少。
第五十七條:哺乳時間
本公司女工其子女未滿一歲須親自哺乳者,於休息時間外,每日得於工作時間內哺乳二次,每次以三十分鐘為度。
第八章 撫卹

第六十七條:撫卹
員工因公而致殘廢或死亡時,依勞工保險條例向勞保局申請給付,始尚未參加勞保者,其津貼及輔助事宜悉依勞工保險有關規定予以補償。

第九章 福利措施與安全衛生

第六十八條:勞工保險
本公司勞工均由公司依法令規定辦理勞工保險及全民健康保險,並依相關法令享有保險給付權利。對於同仁生育、傷病、殘廢、老年、死亡等之給付,亦由本公司依「勞工保險條例」及「勞工保險條例施行細則」,由公司辦理轉請勞保局給付。
本公司勞工到職後如尚未辦妥勞工保險手續前,發生意外事故,致受傷害者,公司應照勞工保險條例規定辦理之。
第六十九條:職工福利
1.員工婚喪、住院,致贈禮金、奠儀或慰問金。
2.每年另有三節獎金。
3.上班時段提供中餐。
4.提供英文進修課程一半金額。
5.提供健身防活動一半金額。
第七十條:福利共享
凡本公司勞工均得享受本公司之一切福利事項。
第七十一條:福利及紅利
本公司於營業年度終了結算,如有盈餘,除繳納稅捐、彌補虧損、公積金外對於全年工作並無過失之勞工,給予年終獎金或紅利獎金。
第七十二條:安全衛生
1.清潔人員一星期來依次,請務必注意個人的清潔問題。若有食物的垃圾產生時,請先密封再丟進大的垃圾桶或樓梯間的垃圾桶或直接自行丟棄,避免臭氣及衛生問題產生
2.空紙箱或其他包裝也請儘早楚哩,乾淨的環境才能有好的工作氣氛。

第十章 附 則

第七十三條:勞資會議
本公司為協調勞資關係,增進彼此瞭解,促進勞資合作,提高工作效率,依「勞資會議實施辦法」舉辦勞資會議。定期開會,相互溝通意見,勞雇雙方應本和諧誠信原則,協商解決問題
第七十四條:意見溝通
員工如以口頭申訴,應由祕書作成紀錄,立即陳報處理。
勞工如有權益受損,或有其他意見時,得以書面直接依行政系統,提出申訴事項,各單位主管應立即查明處理,或老闆處理,並將結果或處理情形通知申訴人。
第七十五條:補充規定
本規則若有未盡事宜或涉及勞工其他權利義務事項,本公司得依實際需要,並依有關法令規定之。
第七十六條:實施
本規則經呈報主管機關核備後公告施行,修正時亦同。
