It is definitely fair to say that if company ABC is found guilty of breach the contract.
我當初是翻 說ABC公司被認定犯下違約之罪很公平的~
可是，有人跟我說, it is fair to say是用於假設語氣
我這樣翻是錯誤的!
請問有高手可以幫忙一下~幫我看一下要怎麼翻嗎

先看看字典怎麼說：
依據Cambridge Advanced Learner Dictionary
it's fair to say的意思是 it is true to say
看例句：
I think it's fair to say (that) you've done less of the work than I have.
再看fair的常用解釋：
treating someone in a way that is right or reasonable, or treating a group of people equally and not allowing personal opinions to influence your judgment
指的是以公正合理的態度對待他人，或不受他人影響其判斷，不偏不倚的對待某人
再看看Oxford Advanced Learner Dictionary
fair的 相關解釋是treating everyone equally and according to the rules or law
例句
I think it is fair to say that they are pleased with this latest offer.
So, it is fair to say翻成
正式點： 持平而言，~
白話點： 說真的，~

由這句話的內容來看, if後面的話應是支持(呼應)前面所說ABC公司違反司法的事, 所以, 您這句應是翻成:
ABC公司被裁定為違反了合約的話是相當恰當的..........

最 好 要 把 'to say' [給 擦 掉 ﹐ fair to say 意 思 即 是 說 ‘你 覺 得 是 這 樣 ’。 所 以 整 個 line 不 是 一 個 句 子 。
It is definitely fair to say that if company ABC is found guilty of breach of contract, then...要 補 充 一 個 clause 上 去
如果想說ABC公司被認定犯下違約之罪很公平的﹐ 就 寫 ﹕
It is fair if ABC is found guilty of breach of contract.
Or
It is fair if ABC is found guilty of breaching the contract.
