Dear All,

I am an U.S. citizen, can't type chinese but please feel free to reply me in either English or Mandarin.

I am desperately in need for advisement!

My ex-wife entered in January, 2004 a week after she entered U.S. She requested to apply her green-card

Baby was born on Feb, 2005.
My ex-wife had her interview with INS on May, 2005. but lacked some documents. we were given 90 days to prepare the documents (tax forms... ) but we did not prepare it because on the summer of 2005, our marriage had significantly breakdown, mainly because my ex-wife's parents got so involved with my marriage life, however, I did submit an appeal after 90 days to re-open the case (got granted)

Marriage got worsen by her parents, I then requested divorce on September, 2006; the same month we got the immigration service's notice stated denial further process for my ex-wife's green-card application. Beats me, I have no clue why!

She went back to Taiwan on Novemeber, 2006 but still weren't able to straighten things out to her parents....

She applied travel/visitor visa from AIT, but rejected.

My question is:

1. If my ex-wife is tagged as overstays in U.S... in this situation, how long is she considered overstays in U.S.?

2. If we consider to bring back the marriage together again, will she likely be granted back in U.S. with CR-1?

3. how likely would AIT give her a chance to come back to U.S. if my ex-wife and I explain that we didn't know about the extended process her her prior entrance to U.S. because we were already in process for green-card.

4. Will my ex-wife be facing the consequence not able to enter back to U.S. for 10 years?

5. Any advisement is highly welcome and I'd really appreciate all of your suggestion to assist my ex-wife and my situation.

說真的我英文不是很好,很多部分步是很了解,我無法一一回答你,所以我將我知道的跟你說!

1.關於你想要用CR1簽證讓你老婆再回美國的事情,我要跟你說...那是不可能的ㄟ。因為從今年1/23開始,AIT不能發CR1簽證與相關移民簽證囉!所有移民簽證都要由美國公民由美國提出申請!

看起來你老婆現在在台灣囉!我不知道你老婆因為預期居留有沒有被美國線至幾年不能在入境呢?這點沒看你說明!

說真的你的Case比較特別,建議你尋問美國律師,也許可以真正對你有幫助!

不知道你現在baby在哪呢?因為baby是美國公民,也許問問律師看看孩子的媽媽能否因為要照顧孩子而可以跟孩子一起待在美國喔!

關於樓下大大說的『臨時綠卡』的時間有點不一樣,我稍微解釋一下。
1.關於這種結婚移民,剛申請時拿的是『臨時綠卡』,當你們的婚姻滿2年的時後就可以提出申請轉換成正式綠卡。當你們在結婚2年內離婚的話(不是5年喔),被申請人同時也失去『臨時綠卡』的資格。(當然也有一些例外的案件可以申訴)。
2.也就是說若你是拿到正式綠卡而離婚的話,美國是無法取消你綠卡的資格,除非是你住在美國的時間不符合規定。

當然說這個部分對你並沒有幫助,因為事情已經發生了,只能建議真的找專業律師幫助你這個真的比較複雜的狀況吧!

根據移民局的規定
曾在美國逾期居留超過6個月禁入境3年,一年則禁10年
即使公民的立即親屬也是一樣

1.據我所知,若你是美國公民,他是因為你而拿到綠卡,這稱為暫時綠卡,也就是說,在五年之內若你們離婚了,他就無法申請成為美國公民,當然綠卡也就失效
很抱歉,你們走到這一步..太早(只能怪他爸媽太管事)
2.如上面大大所說,從今年起已經取消CR-1簽證,若你要申請結婚簽證必須經由美國通過,台灣已經不再有權利簽下cr-1
所以你們不能再使用cr-1簽證anymore
3.我想目前你前妻無法用任何簽證入美國,或者你可以試試看K-1簽證(未婚妻簽證),讓你前妻依靠k-1簽證入境美國,必須在90天內完婚
只不過,不論cr-1或k-1簽證,都必須附上婚姻紀錄,你們恰巧又是童一對夫妻結婚離婚又結婚,可能會比較困難
我建議你,直接寫mail給AIT詢問,美國許多當地律師反而不見得解答的正確,問AIT是最快最好的辦法!!
4.我想他應該不會到10年都不能入境美國,沒有這麼嚴重
如果真的如此,只能讓你回台灣與他居住,或等孩子長大了替你前妻半綠卡,不過我想你也等不下去
還是一句話,直接 寫MAIL問AIT,或請你前妻直接去AIT詢問,他們可能語氣不是很好,但還是回答你的
