If it was dishonest by those standards,then the jury must consider whether the defendant himself must have realized that what he was doing was by those standards dishonest. In most case ,where the actions are obviously dishonest by ordinary standards, there will be no doubt about it. It will be obvious that the defendant himself knew that he was acting dishonestly ,even if he asserts or genuinely believes that he is morally justified in acting as he did.

若基於那套標準* 判定某行為屬不誠實, 陪審團須考慮被告在進行這些行為時, 是否已明白自己的行為在那套標準下會被視為不誠實.

在大部份情況下, 如果被告所作的是根據一般人採用的標準便能清楚判定的不誠實行為, 那便沒有疑問, 因為顯而易見, 被告本身不可能不知道自己的行為是不誠實的, 即使他辯稱自己真心相信自己的行為合乎公義.


*上文應該已提及是甚麼標準, 若沒有上文, 用^一套標準^ 便容易明白
