To be liable to Hong Kong profits tax, a person must carry on a trade, business or profession in Hong Kong. If the person merely trade with Hong Kong, he is not liable to profits tax. 一個人必須在香港從事持續性的貿易, 商業, 或職業行為, 才會被香港課征盈利稅. 如果只是以香港為交易對象則否. 至於是否在香港從事持續性的商業行為, 主要是根據事實來認定. 也就是說, 只要在香港設有永久性的機構, 想當然耳必定有貿易行為. 然而, 如果貨物只是購自或銷至香港, 將不會被視為在香港從事貿易行為.
