I sent him rent for the month of July and he claims he never got it. I keep copies of everything so I faxed him copies of the moneyorders and the stubs so that he had proof that I sent it. This week he still states he never got it and ask for a stop and reissue. That is fine, but when he finds out it is going to take up to 30days for the refund to be turned around he sends me an email stating whats happening with his rent so he can get me to send more. He also stated that this happend a few weeks back with another tenant, but refuses to believe that there may be a problem on his end. IE someone tampering with the mail. What would you do? And can he evict me and my family ( Me, Husband, & toddler) Also he is an attorney...

Yes Angel I am being very honest. Otherwise I would have not faxed him copies of the fronts of the moneyorders as well as copies of the stubs. I don't have another 1145. to give him when next payment for August rent is so near. I don't know what to do. I have been nothing but a good tenant and have never been late with rent. I feel like I am being used. The reissued money orders are suppose to be in his name. He also asked me not to send rent by certified mail. I feel like he has an agenda because he has frequently lied to us about alot of things in this apartment.

Don't listen to Angel...she is representing herself as a lot of jobs on this fourm...sometimes it's a banker other times its an apartment manager. All she needs is to be a candle stick maker and she's all set right!

Anyway...if it were me and I was sure I was getting the money back for the money orders I would pay August rent early and inform him that when the refund comes in you will pay July's rent (he can call it July and August if he wants). If you have a good history of ontime payments he really shouldn't be too upset by this.

Also I would make sure to get a reciept for this...when I worked as a bank teller I had an apartment manager come in saying we had not deposited some checks into her account because her books were off and what not...anyway long story short after we pulled all the checks she had deposited that month she had mislabeled one tenants money order as another tenants payment. It was a huge mess on her part. So I learned then to always get a signed reciept (or send it certified mail so I could get that little green card back saying they had received it!!)

You're in a tough situation. Technically, yes, he can ask for the rent even though it's being reissued by the company that stands good for the money order. He can't access a penalty for late if you have proof that the money order was sent prior to the rent due-date. He could evict you, but I don't believe he will. It's not in his best interest, UNLESS you've been chronically late with your rent in the past. Good luck.

I would see if the issuer of the money order can verify if it was cashed and, if so, by whom? They may be able to show you the endorsement signature or a copy of it. From now on I suggest either hand delivering the money order and making him sign a receipt for it, or spend a couple of extra bucks to send it registered mail. Who knows, maybe if you ask him he'll deduct the cost of sending it registered mail from the rent amount.

He could evict since he didn't get the rent. You should find a way to get the money to him even if you have to borrow it from your parents. If you had given him a check instead of a money order you could have put on a stop payment then issued a new one.

There are laws that protect renters from abusive landlords. Check with the Better Business Bureau and also the state attorney generals office. Im sure that if they cant help you, they can at least guide you to the proper agency for assistance.

One thing you can do is ask the Money order company to check to see if the money order was already cashed. They can send you a copy of who signed for it.

YOU should NEVER MAIL money orders for your rent...... UNLESS you have it Certified by Mail, yes there is a fee, but it is well worth it! if you can.. and you live in the same area, take over the rent in PERSON and have him sign a Rent Receipt....... I am an apt manager, and many people try and pull this..... (Yes, you can be evicted) you'll have to pay a late fee, and court costs, it's no fun on anyone's part.. I do my part and I give receipts monthly, and I even take cash......... but if you give cash, have a rent receipt book ready too...
