My husband found a large piece of sharp stone in his burger last night at dinner - we were just lucky one of the children didn't find it instead. It wasn't a "cheap" burger, it was a pack of expensive "top range" ones. He bit down (without knowing it was there obviously) and it shattered one of his teeth. I have heard a lot of people find things in their food that shouldn't be there but what are our chances of compensation, even if just for the amount it's going to cost him to fix his tooth.

It was definitely a piece of stone - not bone - we got it out and looked at it - it's just like a stone you find in the garden or whatever! Scary eh!

Did you report it immediately to the establishment so that there is a record of a complaint? If you did not report it, you may have a hard time proving that it happened there.

What happened to the piece of stone? If they kept it but nothing was documented (written down) it could be tough to prove if they chose to deny the event happened.

What was the reaction of the establishment? In many cases, if you have dealt openly with the establishment they have a standard claim process so that attorneys need not be contacted for them to pay the dentist the cost of repairs.

In many states, any suit for $ 1000 or less is small claims. If your cost for the dental work costs you more than $ 1000 it would be a regular law suit if that is the case in your state. If the establishment does not offer to pick up the cost, contact an attorney to determine what your best course of action would be and the likelihood of success.

I'm no lawyer, but I'd say your chances of getting compensation to fix the tooth are excellent. Just make sure the cost of fixing the tooth is enough to justify what you'll end up paying the lawyer. I think you should just call a lawyer in your area and ask for their opinion. Good luck!

The first thing to do is take the packet and the stone back to the shop and speak with the manager. Explain your problem and that you will need to get your tooth repaired. I feel sure that the retailer will want to put matters right as soon as possible, even though they may need to contact the manufacturers for authority.

You should get some compensation. Speak to some lawyers. I had a friend who was compensated 5 figures for a bloody bandaid in a salad. Don't expect a million dollars unless of course somehow the media gets involved with their dramatic sensationalism.

Take photos and keep packaging, collect all the evidence you can this increases your chances.
You will probably find they make an offer without you having to take legal advice as it is much cheaper for them that way.

If you are in theUk take it to the environmental health at your local council and then trot off to a good solicitor for compo.

that would have been a piece of bone ,not stone .thats what you get for buying expensive burgers,made from real animals,send it back with packageing to manufactures
