It was your responsibility to have a survey done before you bought it - not the vendor. I wonder how you got a mortgage without doing a survey?
The law in the UK states that its the buy's responsibility to make sure that what they are buying is what they think it is and that it is in good condition.
This is all a bit strange and I am not sure if there is anything you can do after 3 yrs.

If you have a mortgage then the property must have been fit to lend on. I suspect there are some details you are omitting that might be helpful to know. Did you buy at auction?

If the flat is in poor condition, get down the DIY store, smarten it up a bit - usual stuff, neutral colours etc. Then let the property and buy something better. Not very difficult to do just takes a bit of thought and motivation. Don't go for anything too expensive, IKEA style is fine, and budget to replace furniture/redecorate every 2-3 years. Factor in any service charges or maintenance fees, and expect it to be empty for at least one month a year.

You only have to live with this situation as long as your are prepared to put up with it.

Good Luck.

YOU should have got the survey done. It was entirely your responsibility.

'The council shouldn't have sold it to me' is a silly thing to say. It was up to you to check that what you were spending your money on was in good condition. The chances are the council won't have looked at it before they sold it so they don't even know what's wrong with it. It is your house now, you'll have to fix it up. Why don't you see if there are any grants available for repairs and improvements for housing in your area? Ask your council!

Shouldnt a buyer get a survey done BEFORE they buy the house?
Thats what most people do.
Think you went into things too quickly without doing proper research. Its not Marks and Spencers, they aint going to refund or exchange now........ sorry

it has always been the responsibility of the buyer, i fear your solicitor should have advised you better. i believe that when the law changes in October 2007 new buyers will not get caught
