Hubby and i were married in 2004 i was was unemployed in 20004 worked briefly in 2005, and didnt go back to work full time til 2006, hubby hasnt filed for 5 years due to procrastination, and not having the proper paperwork for his kids. I have filed every year up til 2004. My question is how do we file? we wernt married til the end of august 2004, do we file differently for the different years?

You were considered married for 2004. You may as well file a joint return for 2004 and 2005, since you had little or no income.

If your individual refund for 2006 is substantial you may want to file separately so that your refund doesn't go to pay his back taxes.

Prior to 2004: You spouse files a separate return, of course.

You should contact the IRS or a tax professional for assistance. 5 years of filing is pretty far back, and you may need a professional's advice to handle the situation properly.

On the other hand, you may be due refunds that you don't know about! You would file differently for the back years. In tax year 2003 and prior, your husband should file as single. In TY2004, you should have filed as married filing jointly or separately, so you may have to amend your return if you did not do so. In TY2005 and TY2006, you should file as a married couple. (TY=tax year)

Best of luck with your situation. I believe the IRS will not provide you with a refund for this year, even if one is legally due to you, until you file all the back tax returns.

You could file alone-this would be easiest. But, if you want to file jointly, you'll need a tax preparer. My hubby and I had similar problems. We filed together for that year. The IRS picked up that we hadn't filed a couple years back. The tax preparer had us gather some paperwork, then filed all the years for us. It wasn't too bad, but IRS is slow.

Yes, for the years including 2004 and after, you'd file as married, either joint or as married filing separately. For years before that, you'd each file as single if that's what you were.

You can either file married/ jointly or married/ seperately. If you file seperately he will be responsible for his and you for yours. If he owes anything and you file jointly, there is a form to fill out to excuse you from what he might owe. It can get complicated, but if you want to save yourself, file seperately and make sure you go back and file for 2005.
