A number of ways, of which I think that the easiest for them is to pose as a user. When you connect to them, they have your IP address for the date and time in question. If they want to go after you, they go to the courts and subpoena your ISP - as they are the holder of the block of IP addresses containing the address used at the time of the infraction. The ISP is bound by law to release who you are to the courts. Once they have the account owners name and address, guess who is knocking at your door the next day with papers in their hand?

This is just one way they can (and have) done it. There are MANY other ways as well - all behind the scenes. Some ISP's try to guard your identity, but they are tired of the millions in legal fees fighting FOR you. Others simply cannot afford to fight and give it up easily.

When it comes to copyright infringement on the net, all they have to do is produce reasonable suspicion. Your active IP address gives them that.

When you download software on LimeWire, your IP address shows up on the computer of who you are downloading from. With this IP address, they can figure out who your ISP is and subpoena (i.e. court order) your ISP to reveal what customer account corresponds to the IP address in question. To see for yourself, open LimeWire and click on the Monitor tab. If you are sharing files, eventually someone will download from you and you will see their info in the "Upload" section at the bottom, including the IP address.
