You have to go to court and file to receive child support. What will happen is the court will order him to pay support. If he does not pay it, he will go into arrears. If he goes into arrears and does nothing to remedy it, he can lose his license and even eventually go to jail. Just because you get an order for CS doesn't mean you'll actually receive it. Good luck.

the only way you'll get money if he has a job. this is why women shouldn't depend on child support. what will happen is he will lose his drivers license, but may not stop him from driving. and if he files taxes they will take his tax return and give it to you. he will have back child support from not paying you and that will suck, he'll be paying back child support plus his monthly amount until he pays all the back child support off. i hope he gets his act together.

Go to the child support agency where you live and put in for child support. My ex quit his job and the child support stopped. In WI, after 120 days, it turns into a felony for him if he doesn't pay. Then, they will arrest him and put him in jail and make him get a job. Then he will have to pay.

Good luck with this its a mine field, my sister stuggles to get any of her childs father cos he has another family with the woman he left her for so he doesnt want to pay for 2 families and there nothing my sister can do, child support agency are flipping useless!!!

It really depends on the laws in your state. If he's on welfare/social assistance, or even disability , he is required to pay you a percentage.
I was talking to this lady at my bank, discussing my frustration with my ex's child support um... conduct... anyways, she starts going on and on about how her sister lives in England and they don't have problems with dads not paying support, if they don't have a job, the government will provide them with one and force them to work!
You really need to speak to a lawyer. if you need financial assistance with that, you can contact a local social service agency, they can probably let you know about 'free lawyers' that you can have a consultation with.

You'll have to get an order based on what he should be able to make with his level of skill. Then, if he doesn't pay you turn him in. In my state (Idaho) a nonpayer can lose their driver's license and business license.

If he is court ordered to pay once he is working again he will have to pay what he isnt paying now its called arrears.

Go to court. If hes on unemployement they will take it out of that. If not, im sure they will figure something out.

well, the honor system doesnt work, thats been proven.
the court doesnt care if he doesnt have a job, they have ways of making them....go....get....one. you see, the state and federal government are TIRED of people not paying for their children, so they passed stronger laws.
you need to arm yourself with the laws; learn them, learn them all.
1) call your caseworker and ask:
--where you apply for interest on the arrears?
--was the case submitted for tax refund intercept?
--was the arrears reported to the credit reporting agencies yet?
2) sit down and write a letter. in it, give your contact info, case number, his info, arrears amount, him not working/sending support and ask them what they are doing about it.
then take that ONE letter and FAX it to the following:
a) your states Attorney General (link is below)
b) your states Governor (link is below)
c) your states Regional FEDERAL Child Support Office (link is below)
phone calls are useless; they are ignored, denied and forgotten. mail ends up on someones "to do" pile, but FAXES are effective. its proof you sent it and proof they recieved it, therefor, they HAVE to address it. if you cant find a fax number (most are listed online) then just call them and ask for it.
if you hear nothing in a week, fax them again. fax them weekly if need be. its the squeaky wheel that gets the oil, if ya know what i mean.
3) post his DEADBEAT FACE ON A DEADBEAT SITE ONLINE.
