My brother all you need to do is be on any public space , it doesn't matter how you get there, so long as you are drunk and cant walk the straight line, whether you are on foot or on a ride you can be charge with something from the books.

You can be charged for DWI when riding a bicycle. Every now and then they catch an Amish or Mennonite around here, so horses aren't exempt either. Since it's illegal when boating they can even get you for a rowboat. The Coast Guard has authority on all navigable waterways, including lakes. There was a guy who had his license suspended and went down the shoulder of the road on a riding mower to get a case of beer. The cop couldn't stop him as he was going down, but he did on the way back because once he used the mower to haul something, he wasn't allowed to under suspension. I'm not sure where the authority extends if you're not on a public roadway, but the riding mower was on the shoulder and the bicycle was in a mall parking lot. All you have to do to give the police authority is to cross a road, though. You can do what you want on your own property but not on public land (like on a trail in a park). Private land that's not yours is iffy and depends on the circumstances.
As to whether you SHOULD be able to be charged, that's a different matter. I think that anything human powered should be at your own risk and not affect your license. Any powered vehicle and even a horse poses a greater risk to others if not properly controlled.

OH, yes. At MY favorite desert playground, Glamis, California, they will bust you if you are sitting on a off highway vehicle, or in the bed of a truck drinking a beer. Even if the engine is turned off and even if it doesn't belong to you. All you have to do is TOUCH it while drinking, and you get a ticket.

If it is a Motorized Vehicle being driven on Public Property, then if you are drunk, you should be charged with Driving While Intoxicated. If you are on Private Property, then you should no be able to be charged.

for many reasons you should not be drinking and operating machinery, thats like a no brainer, but then again there are lots of no brainers out there. Also being drunk in public even if you are on your property but visible to the public makes you drunk in public.

Well if your driving it instead of riding it (Like a horse which is self propelled and can steer itself ) YES it does qualify as driving while intoxicated
