The law for the HOV lanes in California states "California law requires that in order to utilize the HOV lane, there must be two (or, if posted, three) separate individuals occupying seats in a vehicle. Until your "passenger" is capable of riding in his or her own seat, you cannot count them"

That is a contaversal issue, weather an unborn baby is known as a human being yet or not.

Technicly no she cant use because there has to be someone occupying another seat.

Who counts as a passenger?
For the purposes of HOV lane travel, adults and children occupying a seat are considered passengers. There are no restrictions on the age of a passenger in the HOV lane.

Unfortunately no. CA law doesn't recognize your unborn child as a person. But if (heaven forbid) you were to get into an accident and your baby was killed, they would issue a death certificate for the baby. Kind of contradictory don't ya think?

no, because a fetus does not yet qualify as a person under the carpool restriction. She will most likely get a ticket if she keeps doing it.

No way, do you think the cops have an ultrasound machine in their squad car? When she HAS her baby and he/she's in the back in the infant carseat use that lane, not until then.

Nopes its illegal! We had a similar case in the news a few months back, and the courts ruled that it was illegal. Congrads on the upcoming baby!

I have heard this before. It was wrong then, and is wrong now. She will be ticketed and end up in court, and will lose because there is legal precedent.
