Its very hard to remove children from a custodial parent. You need to start documenting everything. If you can afford to hire a private investigator I suggest you do it. If you cant, Try to so as much as you can on your own. Following the laws! You do not want to go and hurt your own case by breaking any laws.

If its abuse. You need to get Children Protective Services involved. Contact your local chapter and explain to them what is going on. They will also be able to handle cases of neglect.

If she is doing drugs. This is going to be one of the hardest to prove. It seems even if her tests will show she is positive you will need to show that she is in fact doing them in front of the kids for them to actually be removed from her.

If it is neglect a trip to a pediatrician with the children will help. If they are dirty, underfed, etc. If they are always sick getting the doctor records will help. If you receive them sick start bringing them to the doctors to show a pattern.

Call children services and file a complaint, they will investigate if their is an issue of her being unfit. Then it will go to court and you can file for custody on the grounds that the mother is unfit. God bless****

You're going to have to be able to prove - and this means hard evidence that the mother is unfit. No rumor, he said/she said, but evidence that a Court will accept.
Documented drug use, criminal activity, documented child neglect, etc. is what you need.

You better be able to prove that the mother is unfit, otherwise you may be looked upon as the bad guy.

Proving a mother unfit is tough. It has to be something really, really bad..... document everything and get witnesses for as much as possible.

being unfit is relative-it takes a bad addiction, very bad habits. if she doesn't use cocaine in front of kids, it'll be hard to prove her unfit.
