Someone on here told me that you can only file for divorce in the state you were married in. My best friend's husband assaulted her, and she's going to file for divorce. She was married in MD but they've lived in PA since they were married. Can't she file in PA since all states recognize a legal marraige, regardless of the state they were married in?
Backing your answer up with a website would help, if possible. Thanks!

In PA, you HAVE to have a lawyer to file for divorce unless both parties agree to get divorced.

My experience, is that my ex wife and myslef were married in TX, then she deceided to file for divorce in AZ, and she thought she had the upper hand beacuse she was born and raised in AZ, and all her friends and family were in AZ, and she went through a certain court that happended to have a woman judge handle our divorce hearing, and long story short, I got full and sole custody of our kids, she was ordered to pay me child support. So yes, you can file in the state you claim as your state of residency.

Your friend can file a divorce any where she wants. It doesn't have to be the state they were married in.All she needs is a lawer that is all. Husband doesn't have to be in the same state either. A lawer can do it. But yes she can file where ever she is. Some people on here is so full of sh_t it aint funny. Good Luck and Merry Christmas. Sorry I have no website. I know this cuz my ex husband lives in Colorado and I live in Mo. and he filed and I didn't have to be there. The judge granted it with out me being there. Ex said he didn't know where I was and ran it in the news paper I think he said 90 days.

You have to file for divorce in the state you were married in - if the state you were married in requires it. Most of them do require it.
Filing is a fairly simple chore, but one that is best handled by an attorney.
Sorry- no do it yourself advice here. Marriage is the only war in which you sleep with the enemy, so I am going to advise you get as much professional assistance as possible to avoid serious problems and complications ater.

You can file for divorce in any state in the union, I was married in California and filed for and got divorced in Texas. She just needs to go do it. She will probably need to be a resident for a period of time before she can file, it varies by state.

I think you can file in any state. I got a divorce and I was married in Florida and got my divorce in Ohio. My lawyer just asked what state I was married in. If she calls to see about a lawyer she can always ask them before even hiring them as her lawyer and they should be able to answer that question without charging her.

I got married in Vegas but I filed for divorce in Los Angeles where my husband and I resided at the time. Divorce papers are filed in the county of residence if you've lived there at least six months.

I wasmarried in Tx, then moved back home to Maine, but had to go back to TX to take care of divorce. As far as I know this goes for everywhere. Have to file in same state BUT my husban had this problem and is in military, so was waived having to go to any court apperances or go to the state that the marriage was in all together. She should get a lawyer to check into it to be sure about her rights.

I have no clue. I think you can file for divorce in any state, though regardless of where you were married.

In the USA, you can file in whichever state you live in, regardless of where you were married.
