Even though the girl is still a minor, she needs to give consent for this procedure. The staff at the abortion clinic should discuss this with her in private, and if she lets them know that she is against the abortion, they will not perform the procedure.

The baby's father has no say in the child until the child is born and he is legally named the father.

In most states, a child does not have the right to "consent" to pretty much anything if the parents make the decision for him/her. In pretty much every state, also, a minor can not "consent" to sex. And since you can't consent to sex, I don't know if you can consent to be pregnant.

Until you're no longer considered a minor (17 or 18 years old, depending on where you are and what the circumstances are), legally, your parents make decisions on your behalf. This means that all major decisions in your life are not up to you, they are up to your parents. Yes, it would be nice if your parents asked your opinion and considered that, but ultimately, under the law, parental consent is needed. Juvenile consent is not.

There have been instances where a juvenile can be emancipated (completely, financially, or medically). That requires going through all the legal channels to get your emancipation, and you have to accept that the judge may not find in your favor. The courts don't just emancipate a minor because he or she doesn't like the decisions made on their behalf. The minor, parents, other family members, teachers, doctors, all would be interviewed to determine if the parents are making bad decisions for the minor, and if the minor is capable of making the best decisions for him/herself. Even if a court says that parents are making bad decisions, that doesn't automatically mean you, the child, get to make your own decisions. It could mean a guardian is appointed for you to make certain decisions (in financial emancipation, this would be if you had some sort of income or financial assets, you wouldn't be handed the checkbook and told to have fun, you would be given someone by the court whose job it is to take care of your money until you're old enough to make the most responsible decisions, or otherwise make bad decisions legally; in medical emancipation, this would mean that maybe your parents aren't making the best decisions, but you aren't capable of them either -- meaning you could be granted medical emancipation, then the final say over the abortion consent may not lie with you after all that).

All that can take some time, of course, and the fact that after a certain amount of time, abortion is not legal (you can't abort a baby in the later stages of pregnancy), could complicate matters.

I freely admit to knowing very little about abortion and the consent of a minor. I would suggest calling an abortion alternative (can be found in the yellow pages, usually the first listing). They could better explain your options.

I am not aware of any cases where a parent forced their child to unwillingly have an abortion. Legally it's the other way around - according to Planned Parenthood v. Casey a state may require a child to get parental consent before getting an abortion, but I haven't read a case of a doctor performing an abortion against the child's wishes.

No reputable abortion provider would perform an abortion on a woman who does not want it. That is why abortion clinics do thorough counseling and explore ALL options with their patients, including adoption and parenting. I have worked in the reproductive freedom movement for years and have never heard of such a situation -- the girl's mother or father may WANT her to have an abortion, but the person who gets to decide is always the person who is pregnant.

Which is the way it should be.

No one can force anyone else to abort their baby in America. It is illegal. If someone is trying to force you or a friend to abort, please go to a crisis pregnancy center as soon as possible. They can help and find you a safe place to stay if that is something you need. All of their services are free and confidential. You can find a center near you by calling 1-800-395-HELP or visiting:

http://www.optionline.org/advantage.asp

They can also give you referrals for financial, medical, and legal assistance; free maternity and baby supplies; pregnancy, parenting, and adoption information; and counseling and emotional support.

If you are pregnant and someone is trying to force you to abort, you need to refuse to go with them to the abortion facility. If they try to force you into the car, kick and scream and make a fuss. Shout, "Call the police!" Remember, your baby's life and your physical and emotional well-being is at stake. If you are pregnant, your baby is depending on you for protection. Be strong. Your father can NOT force you to abort.

truthfully, she probably have been given pregnant with out their permission, so she needs to seek for a therapy that doesn't require their permission. on occasion, even letting her mothers and dads comprehend that she's pregnant is complicated. they might beat her and/or throw her out of the homestead. Or the being pregnant would desire to be a results of incestual rape. Or the mummy's boyfriend would desire to have raped the female (does not TECHNICALLY qualify as incest). certainly one of my husband's nieces had to pass stay along with her grandparents (his mothers and dads) because of the fact his sister KNEW that her boyfriend grew to become into molesting that toddler, yet she grew to become into unwilling to kick the boyfriend out of the homestead. If the toddler had grew to become up pregnant, she would desire to not have been waiting to pass in the path of the criminal equipment in time to get an abortion with out her mothers and dads' awareness and probable permission. you apart from would ought to evaluate that for the time of a few religions and cultures, a woman who even buddies with unrelated adult males is seen a slut, and is in hazard for "honor" killing, nevertheless i come across such techniques to be somewhat dishonorable. it could be super if a woman's mothers and dads could help her and instruction manual her if she exhibits herself pregnant. regrettably, that's not the case. And abortion is an particularly time-delicate situation...waiting even a month or 2 would desire to alter that first trimester being pregnant right into a 2d trimester being pregnant, the place the hazards and costs of an abortion are greater. Many adolescents don't have somewhat regularly occurring cycles, and by ability of the time an adolescent realizes that she's previous due, she would desire to have decrease than a month previously she is going into the 2d trimester. She would additionally be in denial for a month or 2 besides. A pregnant teen (or a pregnant woman, for that depend) has an particularly small window of time to choose.
