He is responsible for the action of drinking in the first place, knowing that he is going to do wrong things, or cause health problems.
Its called action...reaction. He knows what the action of drinking will do, so yes, he is responsible. And yes, they should not charge him full 40.

A person has to be 21 to drink. If he is responsible enough to go out and drink, then I think that he should be be responsible for his actions.

Yes, you are always responsible for your actions. If you are old enough to be considered responsible enough to drink legally, you should be reponsible enough to be aware of your actions. Being drunk makes you lose your inhibitions, but it shouldn't make you lose your head.

Oh yes you can! First of all, anyone who uses this excuse is lame! You know what you are doing the first minute you start to drink, you know what position you are putting yourself into and you know what "can" happen. That's like saying that (in the words of larry the cable guy) that blaming my gun for shootings is like blaming my pencil for misspelled words! Or in this case, my keyboard.
Knowing what might happen or what can happen makes you responsible because the "not having control" is self inflicted!
