In a nut shell heres how it works:
First your attorney request a copy of the quidelines for Qualified Domestic Relation Orders AKA: QDRO "the order that divides the reitierment" from your husbands 401k plan. Then the QDRO is drafted and sent to your husbands attorney for approval. Once approved the QDRO is sent the 401k's attorney's for their approval. Then it is sent back to your attorney for delivery to the judge for signature. After that it is delivered to the Court Clerk for filing. Finally it is sent back to the 401K so they can processes it and cut a check. Yeah, it's a lot of work!

I don't know what your husband does for a living, but I go to work and risk my life each day. If my wife were to think that she'd get my 401K, she'd be fighting a losing battle. He has put in the hours at work, not you, why do you think you should get it?

Perhaps your case isn't as a higher priority as others she has to work on. Perhaps there are other issues still involved with your ex's retirement account, such as... is he retired? I think if he's still working and the account is still active; it's untouchable from divorce actions until he actually retires.

Why did you feel that you were entitled to your ex husbands 401k? Do you have no shame? I can see child support and possibly spousal support if you were a SAHM but going after half of his retirement? What on earth do you possibly have to gain by taking that? How would you feel if the shoe were on the other foot and he was trying to take half of what you were saving for retirement?
