As he is the only one in my family, I would like to get him live with me. He is over 21 yo.

he can not stay here unless he has a visa that permits him to be here until his green card is approved
it can take a while:
my uncle filed for my dad many years ago... and he is not permitted to stay on his visitor visa until the green card is permitted....

"If your brother or sister is outside the United States when an immigrant visa number becomes available, your brother or sister will be notified to go to the local U.S. consulate to complete the processing for an immigrant visa. If your sibling is legally inside the U.S. when an immigrant visa number becomes available, he or she may apply to adjust status to that of a lawful permanent resident using the Form I-485."

technically , he may be here legally, but he can not adjust his status, and if he stays here on his vistor's visa, it could take years to get a green card, and by then he would have over stayed his visa, and eligible for deportation and loose his green card, he won't get in serious trouble as if her entered illegally, but he can not leave and come back, he can not work etc.... but there may be forms you could file to change that.... you could call an attorney and get advice

No, if he stays here is is breaking the law. He needs to return to his country and wait the proper time frame for his visa. Good Luck
