we hired a painter he gave us a verbal quote.the bill he sent us was 3 times the amount.we paid the verbal quote (this was 27 months ago.)he did not cash the check and has since sent us letters every month and sometimes 2(and writing on the outside of the envelope "THESE PEOPLE DONT PAY THEIR BILLS) as well as leaving messages on our answering machine about how lazy we are. he since has sued us in small claims court.
can we coutersue for defamation of character?and if so how does a person determine how much? we have never been sued before(WE Always pay our bills)

If he sued you in Small claims, did you go and ask him why he didn't cash your check for the agreed on amount? Is it possible that he never got it? That he didn't give you a statement of costs was inexcusable unless you thought he included the cost of the paint in the original quote? Have you kept the bills he sent with the insult on the outside? I would talk to a mediator as soon as possible, you know someone who can figure out what is going on because you haven't given enough information here.
