illegal, no matter how many times they try and appeal, they still have to STOP doing it, until they find soemone who agrees with them. Just because a murderer appeals his conviction, doesn't mean he was innocent. Just means it will cost tax payers more to keep re-trying the same case. ILLEGAL!

No, they won't ever. Heidi, the thing is, that the Bushites don't understand what constitutes Constitutional freedoms. They think that the wire tapping is OK because they think that if you aren't doing something wrong why worry. The part they don't understand is that where is the line? Wiretapping millions of Americans to monitor what the average American is doing is a tactic of an Orwellian dictatorship not a free society. The First Amendment protects freedom of the press, freedom of speech and religious freedom. Not, freedom of the press, unless you criticize the government, freedom of only pro-Bush speech, and freedom to pick what christian faith to be a part of. The politicization of every issue is what NeoCons want, but truth is what they never understand.

The reason that it is illegal is because there is no judicial oversight and no congressional approval for this program. For some reason GWB thinks he does not have to follow the constitution. He can still wiretap and always could, he just has to follow the rules, which he has a hard time doing.

Not so fast. Gonzales said they are appealing this to the Supreme Court. And will continue taping John Skerry's phone.
So when the Superior State Court says what you are doing is un constitutional why would a kind and loving president not want to protect and preserve the constitution. He did take the oath of office twice. Surly he remembers what the only job of office is.

Neo-cons and Wall-mart republicans do not seem to know the difference between a LEGAL wiretap that might possibly catch a terrorist and what the administration is trying to do illegally. It takes too many working brain cells to figure out the difference between Domestic and International and they would need to figure out what PROBABLE CAUSE was. And maybe they would even need to know what the constitution said. WAY too much for for people who think the government can keep them safe.

The ruling was not that it's illegal, just that it's illegal without a warrant. The Justice Dept. has already appealed the ruling, so we shall see. However, I agree completely with the ruling. Just get the warrant and do it legally.

That's only 1 liberal judge in 1 court. This issue will be reviewed by numerous judges and will need to have final ruling by the supreme court AND since we know that Dubya was able to get 2 Conservative judges on the supreme court we know how this will be ruled!

well i think it becomes a problem for private communications companies to provide scramblers and decoders to customers who want privacy .
This decision is about the manner in which wire tapping is done and not about its legitimicy .FISA has been taping phones for years but with the proper information filed that meets our constitution .
