if this person goes to a pubic place to party and shows herself and i put this photo of her on my website can she sue me for not taken the picture off?

the pic is not copyrighted or anythin else she was drunk at the brickyard party here in indianapolis and she didn't say anythin until after it was put on the site. but it may also be b/c she is embarrased she has like no breasts at all.

OK again it was the brickyard party here in indy and women show their breasts for beads or money and most don't care if their pics are taken if they don't want their pic taken they will tell the pepole no cams.

only famous people can be photographed whenever whereever.

but regular people, you have to get their consent.

There are specific torts dealing with portrayal in a false light, unauthorized use (false appropriation) of likeness, or with public disclosure (posting) of private information.

The laws vary by state, but generally if the person can show that the picture is not accurate, or that it harms them in some way, they can sue to have it removed, plus possibly for monetary damages. Whether they win or not is a different story.

Is her image copyrighted? Like the Image of Marlin Monroe for instance.

Pictures are pretty much open it is speech that is regulated closely. This is how the porn business gets away with secret pictures. IIRC only NY and CA passed laws to stop secret photo publication.

In many states, there are criminal laws against taking pics of women (and men) without their knowlede/permission and putting them on the internet. There is a fine and a jail term involved. So, I would be very careful about what you are doing.

She can sue you for posting the picture without her permission, especially if you plan to profit from it in some way. Several lawsuits have been filed against "Girls Gone Wild" and similar entities for similar actions.

In a public place she has no "legal" expectations of privacy. May depend on whether or not you publishing the photo involves payment, or can be considered malicious.

If its in a "public space" say a mall, sorry its a free for all. Nothing anyone can do. If your in public you have no "expectation of privacy" and therefore cannot complain if your picture is taken.

Under the new pornography act, if you don't have the regulated documentation, proof of age and all that jazz, it can be considered child porn and you could be charged with that.

If the picture may prove offensive in anyway possible, than yes, she has a right to sew you.
