I know it's not a good idea, because you'd be just asking law enforcement to pull you over to check, but if you aren't drunk and it doesn't contain alcohol or at least very little, (some cough medicines or cold remedies may have just as much alcohol in them, would that be driving with an open container?) what's the legality of doing it?

Maybe I should have said, non-alcoholic, beer tasting beverage. Is beer without the alcohol still beer? I understand the first two responses say it IS illegal, but I want to know why, if you aren't drinking alcohol.

If it was non-alcoholic, then logically it would be the same as having an open soft drink container in the car.

That may not be allowed by some states or counties because of the risk of distraction (same as eating in your car), but it wouldn't fall under the laws for having alcohol because it's not alcohol.

It does differ from state-to-state, and even then there still is a broad difference. Some states say that it's ok, some say it's ok if the driver can't reach it (like the backseat), some states say no way. You should look it up for your own state.
