He is guilty mostly because he was unable to truly turn to the good side, and by the way he did kill the head master you don't get more guilty then that,

Well, considering he was SEEN blasting Dumbledore with a curse, he took an Unbreakable Vow to finish Draco's task of killing Dumbledore if he couldn't, and the fact he's still alive after "completing" Draco's task...I'd go with guilty. However, the real question you might want to ask is whether Dumbledore was in on this whole series of events or not. Remember, Dumbledore was CERTAIN he could trust Snape and I don't think Dumbledore could be so easily fooled.
